EPC requirements for selling your property in Spain

If you are planning on selling your property you will need to make sure you have obtained an EPC before it is advertised, and if you have a property already on the market you will have a week after the 1 June 2013 to prove that you have applied for an EPC. Once it has been applied for, you will have an additional three weeks to acquire it, although you are able to apply for one before 1 June. Energy performance certificates (EPC) are essential when selling a property, as estate agents must ensure that the EPC certificate of your property is clearly visible in the property details. Similar to renting, failing to own an EPC certificate can result in an already agreed sale becoming void, with potential for the buyer to claim compensation. In addition to this there is the chance that you and your estate agents can be heavily fined. If the property was constructed after October 2007 it could be that it already has a Spanish Energy Performance Certificate in which case a new one will not necessary.

EPC regulations for rental properties in Spain

Long Term Rental (anything over 4 months)

If your property is rented out for a period exceeding four months, proof of the EPC will be necessary.

Anyone who wants to long term rent a property in Spain after 1st June 2013 will have to have a registered EPC. If you're already renting a property then you do not need an EPC certificate, although you will do if you rent out the property to a new tenant. If you fail to provide the tenant with the information from the EPC, then your contract can become void, the government can fine you and the tenant could claim compensation from you. If you're renting the property you or your estate agent will have to make sure that you have an EPC. Short Term Rental (Holiday lets)

Some shorter rentals such as holiday rentals, may also necessitate having an EPC depending on the amount of energy used during certain periods when energy consumption is at least 25% of the overall yearly consumption. How to acquire an EPC

There are official energy performance certifiers who will carry out the test and give you the certificate. If you do make any changes to your property to improve its energy performance, you have it reassessed to improve your previous score. The certifier will check the necessary points within the house and enter the new information and calculate the new score. They will then process the test results and should send the certificate back to the property

Energy Performance Certificates (EPCs)

The Royal Decree on 'Certification for Energy in Existing Building', passed in Parliament on Friday 5th of April, has clarified and approved the Energy Efficiency certificate - Certificado de Eficiencia Energética (CEE).

The new law states that properties for sale or rent must obtain the CEE from 1st June 2013.

In short, the energy efficiency certificate is a document signed by a qualified assessor that contains information about the energy efficiency of a building according to the calculation method defined by the Ministry of Industry, Energy Development and Tourism.
